Art. 81 Conditions of detention 210
1 The cantons shall ensure that a person in Switzerland designated by the detainee is notified. Detainees may communicate with their legal representatives as well as with their family members and consular authorities both verbally and in writing. 2 Detention shall take place in detention facilities intended for the enforcement of preparatory detention, detention pending deportation and coercive detention. If this not possible in exceptional cases, in particular because of insufficient capacity, detained foreign nationals must be accommodated separately from persons in pre-trial detention or who are serving a sentence.211 3 The needs of vulnerable persons, unaccompanied minors and families with minor children must be taken into account in the detention arrangements.212 4 The detention arrangements are otherwise governed by:

Regeste: Art. 16 Abs. 1 und Art. 18 der Richtlinie 2008/115/EG (Rückführungsrichtline); Art. 81 Abs. 2 AIG (Fassung gemäss Ziff. I des Bundesgesetzes vom 14. Dezember 2018 [Verfahrensregelungen und Informationssysteme], in Kraft seit 1. Juni 2019). Haftbedingungen für ausländerrechtlich festgehaltene Personen. Die ausländerrechtliche Festhaltung hat grundsätzlich in einer speziellen, nur zu diesem Zweck vorgesehenen Vollzugsanstalt zu erfolgen (Ausschaffungsgefängnis). Sie kann bloss in Ausnahmefällen in ordentlichen Haftanstalten vollzogen werden, sofern die Trennung von den anderen Häftlingen - durch eine eigenständige Abteilung - sichergestellt bleibt und ein administrativ anderweitig nicht bewältigbarer wichtiger Grund für dieses Vorgehen vorliegt (E. 4-6). Der nicht anders zu bewältigende Grund für die Unterbringung in einer separaten Abteilung eines normalen Gefängnisses und nicht in einer speziellen Einrichtung (Ausschaffungsgefängnis) ist in der Haftverfügung eingehend zu begründen (E. 8). Das Bundesgericht bejaht im konkreten Fall das Vorliegen eines wichtigen Grundes für die Festhaltung des Betroffenen in einer abgetrennten Abteilung des Regionalgefängnisses Bern (E. 7). |
