Art. 85a Right to work 270

1 Tem­por­ar­ily ad­mit­ted per­sons may work any­where in Switzer­land. In the case of salar­ied em­ploy­ment, the salary and work­ing con­di­tions cus­tom­ary in the loc­a­tion, pro­fes­sion and sec­tor con­cerned must be com­plied with (Art. 22). In the case of tem­por­ar­ily ad­mit­ted refugees, Art­icle 61 AsylA ap­plies271.272

2 Ad­vance no­tice of the start and end of salar­ied em­ploy­ment and any change of job must be giv­en to the au­thor­ity des­ig­nated by a can­ton as re­spons­ible for the place of work. The no­tice must con­tain the fol­low­ing in­form­a­tion in par­tic­u­lar:273

a.
the iden­tity and salary of the em­ployed per­son;
b.
the activ­ity car­ried out;
c.
the place of work.

3 The em­ploy­er must at­tach a de­clar­a­tion to the no­tice, stat­ing that it is aware of the salary and em­ploy­ment con­di­tions cus­tom­ary for the loc­a­tion, pro­fes­sion and sec­tor, and un­der­tak­ing to com­ply with such con­di­tions.

3bis In the case of self-em­ployed work, no­tice must be giv­en by the per­son con­cerned. The no­tice must in par­tic­u­lar con­tain the in­form­a­tion spe­cified in para­graph 2.274

4 The au­thor­ity re­ferred to in para­graph 2 shall im­me­di­ately send a copy of the re­port to the su­per­vis­ory bod­ies re­spons­ible for veri­fy­ing com­pli­ance with the salary and em­ploy­ment con­di­tions.

5 The Fed­er­al Coun­cil shall des­ig­nate the su­per­vis­ory bod­ies re­spons­ible.

6 The Fed­er­al Coun­cil shall reg­u­late the re­port­ing pro­ced­ure.

Die Nachteile, die mit dem Status der vorläufigen Aufnahme im Vergleich zur Aufenthaltsbewilligung für Kinder im Alter von 10 und 12 Jahren verbunden sind, erreichen nicht die erforderliche Schwere, um den Anspruch auf Achtung des Privatlebens im Sinne von Art. 8 EMRK zu berühren (E. 6). Der Status der vorläufigen Aufnahme ermöglicht unter den vorliegenden Umständen auch die Wahrung der übergeordneten Interessen der Beschwerdeführer, wie sie sich aus der Kinderrechtskonvention ergeben (E. 6.7.1).
