Art. 85b Change of canton 275

1 If tem­por­ar­ily ad­mit­ted per­sons wish to move their place of res­id­ence to an­oth­er can­ton, they must sub­mit a re­quest for a change of can­ton to SEM. SEM shall con­sult the can­ton con­cerned.

2 A change of can­ton shall be ap­proved:

a.
to pro­tect the unity of the fam­ily; or
b.
if there is a ser­i­ous risk to the health of the tem­por­ar­ily ad­mit­ted per­son or oth­er per­sons.

3 If a tem­por­ar­ily ad­mit­ted per­son has per­man­ent em­ploy­ment in an­oth­er can­ton or if they are un­der­go­ing vo­ca­tion­al and edu­ca­tion­al train­ing there, their move to that can­ton shall also be ap­proved, provided:

a.
they are not claim­ing so­cial as­sist­ance for them­selves or for their fam­ily mem­bers; and
b.
the per­son con­cerned has been em­ployed for at least twelve months or it is un­reas­on­able to ex­pect them to re­main in their can­ton of res­id­ence due to the com­mute or work­ing hours.

4 The change of can­ton in ac­cord­ance with para­graphs 2 and 3 shall not be ap­proved if any grounds spe­cified in Art­icle 83 para­graph 7 let­ter a or b ap­ply.

5 A change of can­ton by tem­por­ar­ily ad­mit­ted refugees is gov­erned by Art­icle 37 para­graph 2.
