Art. 42 Rights of appeal

1 De­cisions by the Ser­vice are sub­ject to ap­peal in ac­cord­ance with the gen­er­al pro­vi­sions on fed­er­al ad­min­is­trat­ive justice.

2 The plea that the re­quire­ments for or­der­ing the sur­veil­lance have not been met is not an ad­miss­ible ground for an ap­peal against a de­cision by the Ser­vice.

3 An ap­peal does not have sus­pens­ive ef­fect ex­cept where the de­cision relates to a cash con­sid­er­a­tion. The ap­peal body may ac­cord sus­pens­ory ef­fect to the ap­peal.
