Federal Act
on Narcotics and Psychotropic Substances
(Narcotics Act, NarcA)1

Art. 29d

1 The can­tons shall is­sue the re­quired reg­u­la­tions for im­ple­ment­ing the fed­er­al law and des­ig­nate the rel­ev­ant au­thor­it­ies and of­fices re­spons­ible for:

a.
the tasks and powers in re­la­tion to pre­ven­tion, ther­apy, re­in­teg­ra­tion, harm re­duc­tion and sur­viv­al sup­port (Chapter 1a), in par­tic­u­lar to re­ceive re­ports on per­sons with ex­ist­ing or im­min­ent dis­orders as­so­ci­ated with ad­dic­tion (Art. 3c);
b.
grant­ing li­cences (Art. 3e, 14 and 14a para. 1bis);
c.
ac­cept­ing re­ports on nar­cot­ics dis­pensed or pre­scribed for con­di­tions oth­er than those per­mit­ted (Art. 11 para. 1bis);
d.
con­trols (Art. 16–18);
e.
pro­sec­u­tion (Art. 28) and for re­vok­ing au­thor­isa­tion to deal in nar­cot­ics (Art. 12);
f.
the su­per­vi­sion of the au­thor­it­ies and agen­cies men­tioned in let­ters a–e and of au­thor­ised li­censed treat­ment and so­cial as­sist­ance agen­cies.

2 The can­tons have the power to charge fees for li­cences that they grant (Art. 3e,14 and 14a para. 1bis) and for spe­cial rul­ings and con­trols.

3 The can­tons shall no­ti­fy the Fed­er­al De­part­ment of Home Af­fairs of their im­ple­ment­ing reg­u­la­tions.
