Art. 38 Invalid ballot papers and candidate votes
1Ballot papers are invalid if they

Regeste: a Art. 16 ff. und 77 Abs. 1 lit. c BPR, Art. 34 BV; Anspruch auf Nachzählung im Falle von Stimmengleichheit anlässlich der Wahl des Nationalrats im Proporzverfahren. Die in BGE 136 II 132 begründete Rechtsprechung, wonach ein sehr knappes Ergebnis in einer eidgenössischen Volksabstimmung eine "Unregelmässigkeit" im Sinne von Art. 77 Abs. 1 lit. b BPR darstellt und Anspruch auf eine Nachzählung einräumt, ist auf die Wahl des Nationalrats im Proporzverfahren nicht anwendbar (Art. 77 Abs. 1 lit. c BPR), weil das Verfahren von Dringlichkeit geprägt und im Einzelnen vom BPR detailliert geordnet wird (E. 2 und 3). |
