Art. 19 Date of the election

1 The or­din­ary gen­er­al elec­tion to the Na­tion­al Coun­cil shall be held on the second last Sunday in Oc­to­ber. The can­ton­al gov­ern­ment shall fix the earli­est pos­sible date for by-elec­tions and sup­ple­ment­ary elec­tions.

2 The Fed­er­al Coun­cil shall fix the date for an ex­traordin­ary gen­er­al elec­tion in terms of Art­icle 193 para­graph 3 of the Fed­er­al Con­sti­tu­tion.42

Regeste: a Art. 16 ff. und 77 Abs. 1 lit. c BPR, Art. 34 BV; Anspruch auf Nachzählung im Falle von Stimmengleichheit anlässlich der Wahl des Nationalrats im Proporzverfahren. Die in BGE 136 II 132 begründete Rechtsprechung, wonach ein sehr knappes Ergebnis in einer eidgenössischen Volksabstimmung eine "Unregelmässigkeit" im Sinne von Art. 77 Abs. 1 lit. b BPR darstellt und Anspruch auf eine Nachzählung einräumt, ist auf die Wahl des Nationalrats im Proporzverfahren nicht anwendbar (Art. 77 Abs. 1 lit. c BPR), weil das Verfahren von Dringlichkeit geprägt und im Einzelnen vom BPR detailliert geordnet wird (E. 2 und 3).
