Art. 27 Multiple candidacies 53
1 If the name of a candidate appears on more than one candidate list in any constituency, the name shall be deleted immediately by the canton from all the candidate lists on which it appears. 2 The Federal Chancellery shall immediately delete from the candidate list any candidate whose name already appears on an electoral list or a candidate list in another canton. 3 The Federal Chancellery shall immediately notify the cantons concerned of the deletions that it has made. 53Amended by No I of the FA of 18 March 1994, in force since 15 Nov. 1994 (AS 1994 2414; BBl 1993 III 445). Regeste: a Art. 16 ff. und 77 Abs. 1 lit. c BPR, Art. 34 BV; Anspruch auf Nachzählung im Falle von Stimmengleichheit anlässlich der Wahl des Nationalrats im Proporzverfahren. Die in BGE 136 II 132 begründete Rechtsprechung, wonach ein sehr knappes Ergebnis in einer eidgenössischen Volksabstimmung eine "Unregelmässigkeit" im Sinne von Art. 77 Abs. 1 lit. b BPR darstellt und Anspruch auf eine Nachzählung einräumt, ist auf die Wahl des Nationalrats im Proporzverfahren nicht anwendbar (Art. 77 Abs. 1 lit. c BPR), weil das Verfahren von Dringlichkeit geprägt und im Einzelnen vom BPR detailliert geordnet wird (E. 2 und 3). |
