Art. 46 Notification of suspicious goods 27

1 The Fed­er­al Of­fice for Cus­toms and Bor­der Se­cur­ity (FO­CBS) is au­thor­ised to no­ti­fy the right hold­er of a filed design if there is any sus­pi­cion that un­law­fully man­u­fac­tured items may im­min­ently be brought in­to or taken out of Swiss cus­toms ter­rit­ory.28

2 In such cases, the FO­CBS29 is au­thor­ised to with­hold the items for three work­ing days in or­der that the right hold­er may file an ap­plic­a­tion un­der Art­icle 47.
