Art. 12c Dispute resolution 39

1 OF­COM shall es­tab­lish a dis­pute res­ol­u­tion ser­vice or shall en­trust this to third parties. In the event of dis­putes between cus­tom­ers and pro­viders of tele­com­mu­nic­a­tions ser­vices or value-ad­ded ser­vices, either party may in­voke the ser­vice.

2 The party in­vok­ing the dis­pute res­ol­u­tion ser­vice shall pay a hand­ling fee. The pro­vider of tele­com­mu­nic­a­tions ser­vices or value-ad­ded ser­vices shall bear the costs of the pro­ced­ure minus the hand­ling fee.

3 The parties are not bound by the dis­pute res­ol­u­tion de­cision.

4 The Fed­er­al Coun­cil reg­u­lates the de­tails.
