Art. 2 Scope

1 This Act ap­plies to:

a.3
the hand­ling of medi­cin­al products and med­ic­al devices (thera­peut­ic products);
b.
nar­cot­ics as defined in the Nar­cot­ics Act of 3 Oc­to­ber 19514, in­so­far as they are used as thera­peut­ic products;
c.
thera­peut­ic treat­ments, such as gene ther­apy, in­so­far as they dir­ectly re­late to thera­peut­ic products; the Fed­er­al Coun­cil may en­act pro­vi­sions spe­cif­ic to this sub­ject.

2 The Fed­er­al Coun­cil may com­pletely or par­tially ex­empt med­ic­al devices in­ten­ded for use on an­im­als or in veter­in­ary dia­gnostics from the scope of this Act.

3 It may make sub­ject to this Act cer­tain products without an in­ten­ded med­ic­al pur­pose which are com­par­able to med­ic­al devices in terms of func­tion­ing and risks pro­file.5

Regeste: Art. 8 EMRK, Art. 10 Abs. 2 und Art. 13 Abs. 1 BV, Art. 9 und 10 BetmG, Art. 48 BetmV, Art. 24 und 26 HMG; Abgabe von Natrium-Pentobarbital für den begleiteten Suizid einer psychisch kranken Person. Natrium-Pentobarbital kann einem Sterbewilligen weder nach dem Betäubungsmittelrecht noch nach dem Heilmittelrecht ohne ärztliche Verschreibung abgegeben werden (E. 4). Art. 8 EMRK bzw. Art. 10 Abs. 2 und Art. 13 Abs. 1 BV verpflichten den Staat nicht dazu, dafür zu sorgen, dass Sterbehilfeorganisationen oder Suizidwillige Natrium-Pentobarbital rezeptfrei beziehen können (E. 5-6.3.6).

Regeste: Art. 1 StGB; Art. 10, 11 Abs. 1 und Art. 20 Abs. 1 lit. e BetmG; Beihilfe zum Suizid; Verschreibung einer tödlich wirkenden Substanz (Natriumpentobarbital); Legalitätsprinzip. Die Verschreibung von Natriumpentobarbital durch einen Arzt an eine gesunde, urteilsfähige und sterbewillige Person stellt kein Verhalten dar, das strafrechtlich unter Art. 20 Abs. 1 lit. e BetmG subsumiert werden kann (E. 3).
