¹ The ef­fects of the mar­it­al prop­erty re­gime on a leg­al re­la­tion­ship between a spouse and a third party are gov­erned by the law of the state in which that spouse was dom­i­ciled at the time when the leg­al re­la­tion­ship arose.

² However, these ef­fects are gov­erned by the law ap­plic­able to the mar­it­al prop­erty re­gime if the third party knew or should have known that law at the time when the leg­al re­la­tion­ship arose.
