2. Jurisdiction at the place of origin If the parents are not domiciled in Switzerland and the child does not have his or her habitual residence there, the courts at the Swiss place of origin of either parent have jurisdiction to hear an action to declare or contest a parent-child relationship, provided the action cannot or cannot reasonably be expected to be brought at either parent’s domicile nor at the child’s habitual residence. Art. 23 Abs. 3 und Art. 70 IPRG wollen die Entstehung von Rechtsverhältnissen vermeiden, die nur von einem Staat anerkannt werden. Der Erwerb einer ausländischen Staatsangehörigkeit, um ein ausländisches Urteil über die Feststellung des Kindesverhältnisses zu erlangen, verletzt diese Bestimmungen nicht und ist in der Schweiz zu anerkennen (E. 3). |
