1 In respect of protection of children, the jurisdiction of the Swiss judicial or administrative authorities, the applicable law and the recognition and enforcement of foreign decisions or measures are governed by the Hague Convention of 19 October 199653 on Jurisdiction, Applicable Law, Recognition, Enforcement and Co-operation in Respect of Parental Responsibility and Measures for the Protection of Children. 2 In respect of protection of adults, the jurisdiction of the Swiss judicial or administrative authorities, the applicable law and the recognition and enforcement of foreign decisions or measures are governed by the Hague Convention of 13 January 200054 on the International Protection of Adults. 3 Moreover, the Swiss judicial or administrative authorities have jurisdiction if this is necessary for the protection of a person or of their property. 4 Measures taken in a State which is not party to the Conventions referred to in paragraphs 1 and 2 are recognised if they were taken or are recognised in the State of habitual residence of the child or the adult. 52 Amended by Art. 15 of the FA of 21 Dec. 2007 on International Child Abduction and the Hague Conventions on the Protection of Children and Adults, in force since 1 July 2009 (AS 2009 3077; BBl 20072595). |
