1 Le stra­de na­zio­na­li so­no di pro­prie­tà del­la Con­fe­de­ra­zio­ne e sot­to­stan­no al­la sua so­vra­ni­tà in ma­te­ria stra­da­le.15

2 Gli im­pian­ti ac­ces­so­ri di cui all’ar­ti­co­lo 7 so­no di pro­prie­tà dei Can­to­ni.16

Regeste: Verordnung über die Nationalstrassen (NSV): Verbot des Alkoholverkaufs in Autobahnrestaurants. Gesetz- und Verfassungsmässigkeit von Art. 4 Abs. 4, 2. Satz NSV. Die allgemeine Gesetzgebungskompetenz des Bundes auf dem Gebiete der Nationalstrassen bezieht sich nicht nur auf den Bau und Unterhalt von Nebenanlagen, sondern auch auf deren Betrieb (E. 3). Das Verbot, in Autobahnrestaurants Alkohol zu verkaufen, geht nicht über den in Art. 7 Abs. 2 NSG vorgesehenen Delegationsrahmen hinaus, obwohl es in der Bestimmung nicht ausdrücklich erwähnt wird (E. 3 und 4). Das Verbot verstösst auch nicht gegen das Verhältnismässigkeitsprinzip (E. 5).
