Art. 35 Support for measures undertaken by private sector and public entities

1 The Con­fed­er­a­tion may sup­port meas­ures un­der­taken by private and pub­lic en­tit­ies to se­cure na­tion­al eco­nom­ic sup­ply with­in the bounds of the funds ap­proved there­for, provided the meas­ures:

a.
help to con­sid­er­ably strengthen es­sen­tial sup­ply sys­tems and in­fra­struc­ture dur­ing pre­par­a­tions for a situ­ation severe short­ages; or
b.
con­trib­ute sig­ni­fic­antly to the sup­ply of es­sen­tial goods and ser­vices in the case of im­min­ent or ex­ist­ing severe short­ages.
2 The Con­fed­er­a­tion shall de­term­ine the meas­ures that may re­ceive sup­port, the amount of funds and guar­an­tees and the con­di­tions un­der which sup­port is giv­en. In do­ing so it shall take ac­count of the in­terests of na­tion­al eco­nom­ic sup­ply, the cost-ef­fect­ive­ness of each meas­ure and the in­terests of the en­tit­ies in­volved.
