Art. 23 Regulations governing the use of guarantee/collective marks
1The applicant of a guarantee or collective mark must file regulations governing the use of the mark with the IPI1. 2The regulations for guarantee marks shall designate the common characteristics of the goods or services which the mark is intended to guarantee; they shall also provide for an effective control of the use of the mark and for appropriate sanctions. 3The regulations for collective marks shall designate those undertakings that are entitled to use the mark. 4The regulations may not be contrary to public policy, morality or applicable law. 1 Term in accordance with No I of the FA of 21 June 2013, in force since 1 Jan. 2017 (AS 2015 3631; BBl 2009 8533). Das Eidgenössische Institut für Geistiges Eigentum ist nicht legitimiert, einen Entscheid der Eidgenössischen Rekurskommission für Geistiges Eigentum betreffend Eintragung einer Marke auf Grund von Art. 103 lit. b OG mit Verwaltungsgerichtsbeschwerde anzufechten (E. 2). Der absolute Schutzausschlussgrund von Art. 2 lit. a MSchG gilt grundsätzlich auch für die Garantiemarke (E. 3-5). |
