Art. 35b Decision

1The IPI shall re­ject the re­quest, if:

a.
the ap­plic­ant fails to show cred­ible non-use of the trade mark; or
b.
the pro­pri­et­or of the trade mark shows cred­ible use of the trade mark or prop­er reas­ons for its non-use.

2Where cred­ible non-use is shown for only some of the goods or ser­vices claimed, the IPI shall ap­prove the re­quest only to the ex­tent there­of.

3With the de­cision on the re­quest, the IPI shall de­term­ine wheth­er and to what ex­tent the costs of the suc­cess­ful party shall be re­im­bursed by the un­suc­cess­ful party.
