Art. 72 Withholding of goods
1If the Customs Administration, as a result of an application under Article 71 paragraph 1, has reasonable grounds to suspect that certain goods intended to be transported into or out of the customs territory of Switzerland unlawfully bear a trade mark or indication of source, then it shall notify the applicant and the declarant, holder or owner of the goods accordingly.2 2It shall withhold the goods for a maximum of ten working days from the time of notification pursuant to paragraph 1, so that the applicant may obtain preliminary measures. 3Where justified by circumstances, it may withhold the goods for a maximum of ten additional working days. 1 Amended by Annex No 3 of the FA of 22 June 2007, in force since 1 July 2008 (AS 2008 2551; BBl 2006 1). Vom Gesetzgeber kann nicht verlangt werden, dass er selbst die Probleme des Übergangsrechts bis ins kleinste Detail regelt. 2. Die Anwendung eines neuen Gesetzes, das ausschliesslich Inhabern der eidg. Meisterprüfung die Anpassung von Kontaktlinsen vorbehält, auch auf Augenoptiker, die eine lange Berufserfahrung auf diesem Gebiet aufweisen können, verstösst nicht gegen Art. 31 BV, wenn diesen genügend Zeit eingeräumt wurde, sich den neuen Anforderungen anzupassen. |
