Art. 23 Regulations governing the use of guarantee/collective marks
1 The applicant of a guarantee or collective mark must file regulations governing the use of the mark with the IPI19. 2 The regulations for guarantee marks shall designate the common characteristics of the goods or services which the mark is intended to guarantee; they shall also provide for an effective control of the use of the mark and for appropriate sanctions. 3 The regulations for collective marks shall designate those undertakings that are entitled to use the mark. 4 The regulations may not be contrary to public policy, morality or applicable law. 19Term in accordance with No I of the FA of 21 June 2013, in force since 1 Jan. 2017 (AS 2015 3631; BBl 2009 8533). Regeste: Schutzunfähigkeit einer Garantiemarke; Beschwerdelegitimation des Eidgenössischen Instituts für Geistiges Eigentum (Art. 2 lit. a MSchG; Art. 103 lit. b OG). Das Eidgenössische Institut für Geistiges Eigentum ist nicht legitimiert, einen Entscheid der Eidgenössischen Rekurskommission für Geistiges Eigentum betreffend Eintragung einer Marke auf Grund von Art. 103 lit. b OG mit Verwaltungsgerichtsbeschwerde anzufechten (E. 2). Der absolute Schutzausschlussgrund von Art. 2 lit. a MSchG gilt grundsätzlich auch für die Garantiemarke (E. 3-5). |
