1 If an applicant and an organisation enter into an agreement on obligations that relate to public law matters, this agreement shall be deemed exclusively to be a joint application to the authority. The authority shall take account of the effect of the agreement in its ruling or decision, unless the agreement is defective in terms of Article 49 of the Federal Act of 20 December 196836 on Administrative Procedure. 2 Agreements between applicants and organisations on financial or other benefits are not permitted if they relate to:
