Art. 938a

2. Ex of­fi­cio de­le­tion

 

1Where a com­pany ceases it busi­ness activ­ity and if it no longer has real­is­able as­sets, the com­mer­cial re­gis­trar, hav­ing made three calls on cred­it­ors without re­sponse, may de­lete it from the com­mer­cial re­gister.

2If a com­pany mem­ber, share­hold­er, co­oper­at­ive mem­ber or cred­it­or claims an in­terest in main­tain­ing the entry, the court de­cides.

3The Fed­er­al Coun­cil reg­u­lates the de­tails.
