Art. 109

c. Ef­fect of with­draw­al

 

1An ob­li­gee with­draw­ing from a con­tract may re­fuse the prom­ised con­sid­er­a­tion and de­mand the re­turn of any per­form­ance already made.

2In ad­di­tion he may claim dam­ages for the lapse of the con­tract, un­less the ob­lig­or can prove that he was not at fault.
