k. Prescriptive periods for liability 1 Creditors’ claims in respect of the personal liability of individual members may be brought by any creditor at any time up to one year after completion of insolvency proceedings, unless the law provides for their extinction at an earlier juncture. 2 The members’ right of recourse against each other likewise prescribes three years after the date of the payment to which the claim relates.583 583 Amended by No I of the FA of 15 June 2018 (Revision of the Law on Prescription), in force since 1 Jan. 2020 (AS 2018 5343; BBl 2014 235). |
