¹ The right to claim resti­tu­tion for un­just en­rich­ment pre­scribes three years after the date on which the per­son suf­fer­ing dam­age learned of his or her claim and in any event ten years after the date on which the claim first arose.³⁹

² Where the un­just en­rich­ment con­sists of a claim against the per­son suf­fer­ing dam­age, he or she may re­fuse to sat­is­fy the claim even if his or her own claim for resti­tu­tion has pre­scribed.
