¹ The pro­hib­i­tion must be ap­pro­pri­ately re­stric­ted with re­gard to place, time and scope such that it does not un­fairly com­prom­ise the em­ploy­ee’s fu­ture eco­nom­ic activ­ity; it may ex­ceed three years only in spe­cial cir­cum­stances.

² The court may at its dis­cre­tion im­pose re­stric­tions on an ex­cess­ive pro­hib­i­tion of com­pet­i­tion, tak­ing due ac­count of all the cir­cum­stances; in par­tic­u­lar it will have due re­gard to any con­sid­er­a­tion made by the em­ploy­er.
