¹ Un­less oth­er­wise stip­u­lated in the col­lect­ive em­ploy­ment con­tract, its pro­vi­sions re­lat­ing to the form­a­tion, nature and ter­min­a­tion of in­di­vidu­al em­ploy­ment re­la­tion­ships are bind­ing on the par­ti­cip­at­ing em­ploy­ers and em­ploy­ees for the dur­a­tion of the con­tract and may not be derog­ated.

² Any agree­ment between par­ti­cip­at­ing em­ploy­ers and em­ploy­ees that con­tra­dicts the com­puls­ory pro­vi­sions of the col­lect­ive em­ploy­ment con­tract is void and re­placed by those pro­vi­sions; however, such an agree­ment may be val­id if it is to the be­ne­fit of the em­ploy­ee.
