Art. 528

3. Ter­min­a­tion on the death of the settlor

 

1 On the death of the settlor the be­ne­fi­ciary may with­in one year in­sist that the agree­ment be ter­min­ated.

2 In this event, he has a claim against the heirs equi­val­ent to the claim he would have in the event of the settlor’s bank­ruptcy.

Ein Verpfründungsvertrag ist trotz Beurkundung eines zu niedrigen Grundstückpreises als gültig zu behandeln, wenn die nachträgliche Berufung auf den Formmangel gegen Treu und Glauben verstösst (Erw. 2). 2. Art. 529 Abs. 2 OR. Anspruch des Pfründers im Konkurs des Pfrundgebers: Massgebend für die Kapitalisierung der Forderung ist der Wert der Pfrundleistung zur Zeit der Konkurseröffnung (Erw. 3). 3. Gegenstand und Wirkung des Kollokationsprozesses (Erw. 4).
