Art. 928a

II. Co­oper­a­tion between au­thor­it­ies

 

1 The com­mer­cial re­gister au­thor­it­ies shall work to­geth­er to ful­fil their tasks. They shall provide each oth­er with the in­form­a­tion and doc­u­ments that are re­quired to ful­fil their tasks.

2 Un­less the law provides oth­er­wise, fed­er­al and can­ton­al courts and ad­min­is­trat­ive au­thor­it­ies shall no­ti­fy the com­mer­cial re­gister of­fices of facts that re­quire re­gis­tra­tion, amend­ment or de­le­tion in the com­mer­cial re­gister.

2bis The fed­er­al su­per­vis­ory au­thor­ity for the com­mer­cial re­gister shall en­sure that the cent­ral data­base on per­sons does not con­tain entries that are in­com­pat­ible with any activ­ity pro­hib­i­tion or­der un­der Art­icle 67 des Crim­in­al Code767, Art­icle 50 of the Mil­it­ary Crim­in­al Code of 13 June 1927768 or Art­icle 16a para­graph 1 of the Ju­ven­ile Crim­in­al Law Act of 20 June 2003769. It shall in par­tic­u­lar veri­fy wheth­er activ­ity pro­hib­i­tion or­ders no­ti­fied in ac­cord­ance with Art­icle 64a of the Crim­in­al Re­cords Re­gister Act of 17 June 2016770 are com­pat­ible with the func­tions entered in the cent­ral data­base for per­sons.771

2ter If they es­tab­lish in­com­pat­ib­il­ity, they shall in­form the can­ton­al com­mer­cial re­gister of­fice con­cerned.772

2quater The can­ton­al com­mer­cial re­gister of­fice shall re­quest the leg­al en­tity to take the re­quired meas­ures.773

3 In­form­a­tion and no­ti­fic­a­tions are provided free of charge.
