b. In the event of the moth­er’s death

 

1 If the moth­er dies on the day of the birth or dur­ing the 14 weeks there­after, the oth­er par­ent is en­titled to leave of 14 weeks; this leave must be taken on con­sec­ut­ive days from the date of the death.

2 The oth­er par­ent is en­titled to the leave if the re­la­tion­ship with the child is es­tab­lished on the date of death or dur­ing the 14 weeks there­after.

3 In the event of the hos­pit­al­isa­tion of the new-born child in ac­cord­ance with Art­icle 329f para­graph 2, leave in ac­cord­ance with para­graph 1 shall be ex­ten­ded by the dur­a­tion of the hos­pit­al­isa­tion, up to a max­im­um of eight weeks.
