Art. 86b
1 If the proprietor or a licensee of a patent that is valid in Switzerland entitled to institute proceedings has clear indications that goods which infringe that patent may imminently be brought into or taken out of Swiss customs territory, he may request the FOCBS in writing to refuse the release of the goods.196 2 The applicant must provide all the information available to him that is necessary for the FOCBS’s decision; this includes a precise description of the goods. 3 The FOCBS shall make the final decision on the application.
