Art. 31

1 The de­part­ments and the Fed­er­al Chan­cellery shall de­cide with­in their area of re­spons­ib­il­ity on au­thor­isa­tions in ac­cord­ance with Art­icle 271 para­graph 1 of the Crim­in­al Code106 to carry out activ­it­ies on be­half of a for­eign state.

1bis Au­thor­isa­tions in ac­cord­ance with Art­icle 22 of the Fed­er­al De­cree of 21 Decem­ber 1995107 on Co­oper­a­tion with In­ter­na­tion­al Courts for the Pro­sec­u­tion of Ser­i­ous Vi­ol­a­tions of In­ter­na­tion­al Hu­man­it­ari­an Law shall be gran­ted by the Fed­er­al Of­fice of Justice.108

2 Cases of polit­ic­al or oth­er fun­da­ment­al im­port­ance shall be sub­mit­ted to the Fed­er­al Coun­cil.

3 The de­cisions shall be sent to the Of­fice of the At­tor­ney Gen­er­al of Switzer­land and to the de­part­ments that are also in­ter­ested.109
