Art. 5a

1 The com­pet­ent de­part­ment shall de­cide on re­quests from Coun­cil mem­bers and from par­lia­ment­ary com­mit­tees for in­form­a­tion in ac­cord­ance with Art­icles 7 or 150 of the Par­lia­ment Act of 13 Decem­ber 200211 (ParlA). If there is dis­agree­ment between the ap­plic­ant and the com­pet­ent de­part­ment on the scope of the rights to in­form­a­tion, the Fed­er­al Coun­cil shall de­cide.

2 The Fed­er­al Coun­cil shall de­cide in each case:

a.
in the case of in­form­a­tion that dir­ectly serves its de­cision-mak­ing, at the re­quest of the Fed­er­al Chan­cellery;
b.
in the case of in­form­a­tion re­lat­ing to state se­cur­ity and the in­tel­li­gence ser­vices at the re­quest of the com­pet­ent de­part­ment.

3 Re­quests to in­spect Fed­er­al Coun­cil de­cisions are pro­cessed and answered by the Fed­er­al Chan­cellery in con­sulta­tion with the com­pet­ent de­part­ment.
