Art. 8jbis Waiting period for members of administrative and institutional boards of federal institutions entrusted with supervisory and regulatory duties 47

1 The Fed­er­al Coun­cil may set a wait­ing peri­od in the elec­tion res­ol­u­tion for mem­bers of ad­min­is­trat­ive and in­sti­tu­tion­al coun­cils of fed­er­al in­sti­tu­tions en­trus­ted with su­per­vis­ory and reg­u­lat­ory du­ties if it is to be ex­pec­ted that the im­me­di­ate ap­point­ment of a mem­ber after leav­ing the ad­min­is­trat­ive and in­sti­tu­tion­al coun­cil to a po­s­i­tion with em­ploy­ers or cli­ents in the su­per­vised or reg­u­lated area will lead to a con­flict of in­terest.

2 A con­flict of in­terest ex­ists in par­tic­u­lar if:

a.
the cred­ib­il­ity and repu­ta­tion of the in­sti­tu­tion con­cerned or of the Con­fed­er­a­tion may be ad­versely af­fected by this ap­point­ment;
b.
a coun­cil mem­ber has in­flu­ence over in­di­vidu­al de­cisions or ac­cess to in­form­a­tion in such a way that he or she would no longer ap­pear to be im­par­tial if he or she worked for an em­ploy­er or cli­ent in the reg­u­lated or su­per­vised sec­tor.
