Art. 281

L. Pro­vi­sion­al par­ti­cip­a­tion in dis­traint pro­ceed­ings

 

1 If, fol­low­ing is­sue of the at­tach­ment or­der, the at­tached as­sets are dis­trained by an­oth­er cred­it­or be­fore the at­tach­ment cred­it­or may file his own ap­plic­a­tion for dis­traint, the lat­ter shall auto­mat­ic­ally par­ti­cip­ate pro­vi­sion­ally in the dis­traint pro­ceed­ings.

2 The cred­it­ors may de­duct the costs of the at­tach­ment from the pro­ceeds of the at­tached as­sets.

3 In ad­di­tion, the at­tach­ment does not es­tab­lish any pref­er­en­tial right.
