Art. 332

V. Com­pos­i­tion Agree­ment in Bank­ruptcy Pro­ceed­ings

 

1 The debt­or or a cred­it­or may pro­pose a com­pos­i­tion agree­ment. The bank­ruptcy ad­min­is­tra­tion shall as­sess the pro­pos­al for sub­mis­sion to the cred­it­ors’ meet­ing. The ne­go­ti­ations on the same shall take place at the earli­est at the second cred­it­ors’ meet­ing.572

2 Art­icles 302-307 and 310-331 ap­ply mu­tatis mutandis. However, the com­mis­sion­er is re­placed by the bank­ruptcy ad­min­is­tra­tion. Real­isa­tion is sus­pen­ded un­til the com­pos­i­tion court has de­cided on the con­firm­a­tion of the com­pos­i­tion agree­ment.

3 The de­cision on the com­pos­i­tion agree­ment shall be com­mu­nic­ated to the bank­ruptcy ad­min­is­tra­tion. If the com­pos­i­tion agree­ment is con­firmed, the bank­ruptcy ad­min­is­tra­tion shall ap­ply to the bank­ruptcy court for re­voc­a­tion of the bank­ruptcy.
