II. Gen­er­al Pro­vi­sions on the Com­pos­i­tion Agree­ment

A. Ac­cept­ance by the cred­it­ors

 

1 The com­pos­i­tion agree­ment is ac­cep­ted if it has been ap­proved by the time of the con­firm­a­tion de­cision:

a.
by the ma­jor­ity of the cred­it­ors who also rep­res­ent at least two thirds of the total amount of the claims; or
b.
by one quarter of the cred­it­ors rep­res­ent­ing at least three quar­ters of the total amount of the claims.555

2 The debt­or’s priv­ileged cred­it­ors, spouse or re­gistered part­ner are not in­cluded in the cal­cu­la­tion either for their per­son or for their claim. Claims se­cured by a pledge only count to­wards the amount that is un­covered ac­cord­ing to the com­mis­sion­er’s valu­ation.556

3 The com­pos­i­tion court shall de­cide wheth­er and to what ex­tent con­di­tion­al claims, claims with an un­cer­tain due date and dis­puted claims may be in­cluded. This shall not pre­judge the court's de­cision on the leg­al valid­ity of the claims.557
