Art. 247

Coun­ter­feit­ing equip­ment and un­law­ful use of equip­ment

 

Any per­son who con­structs or ac­quires equip­ment for the for­gery or falsi­fic­a­tion of coins, pa­per money, bank notes or of­fi­cial stamps in or­der to make un­law­ful use of such equip­ment,

any per­son who makes un­law­ful use of equip­ment which is used for the pro­duc­tion of coins, pa­per money, bank notes or of­fi­cial stamps,

shall be li­able to a cus­todi­al sen­tence not ex­ceed­ing three years or to a mon­et­ary pen­alty.

Regeste: Art. 19 Ziff. 1 Abs. 6 BetmG; Begriff des Anstaltentreffens. Art. 19 Ziff. 1 Abs. 6 BetmG erfasst Vorbereitungshandlungen qualifizierter Art zu den in Art. 19 Ziff. 1 Abs. 1 bis 5 BetmG genannten Taten. Ein Anstaltentreffen ist nur anzunehmen in Fällen, in denen das Verhalten des Täters nicht ebensogut einem gesetzmässigen Zweck dienen könnte, sondern seinem äusseren Erscheinungsbild nach seine deliktische Bestimmung klar erkennen lässt (E. 1a und d; Präzisierung der Rechtsprechung).
