Art. 81

Work

 

1 The pris­on in­mate is ob­liged to work. Wherever pos­sible, the work should be ap­pro­pri­ate to his skills, edu­ca­tion and train­ing and his in­terests.

2 If he con­sents to do so, the pris­on in­mate may work for a private em­ploy­er.

Regeste: Art. 1, 74 f., 81 Abs. 1 und Art. 90 Abs. 3 StGB, Art. 7 und 10 BV, Art. 7 Ziff. 1 EMRK; Arbeitspflicht im Straf- und Massnahmenvollzug. Die Verpflichtung des Gefangenen zur Arbeit gilt unabhängig von seinem Alter (E. 1). Sie verletzt weder Bundes- noch Verfassungsrecht (E. 2). Die Arbeitspflicht für Eingewiesene gemäss Art. 90 Abs. 3 StGB dient dem Vollzug der Massnahme und stellt keine zusätzliche Bestrafung dar (E. 3).
