Art. 227

Caus­ing a flood, col­lapse or land­slide

 

1. Any per­son who wil­fully causes a flood, the col­lapse of a struc­ture or a land­slide or rock fall and thus know­ingly en­dangers the life and limb of people or the prop­erty of oth­ers shall be li­able to a cus­todi­al sen­tence of not less than one year.

If only minor loss, dam­age or in­jury is caused, a cus­todi­al sen­tence not ex­ceed­ing three years or a mon­et­ary pen­alty may be im­posed.

2. If the of­fence is com­mit­ted through neg­li­gence, a cus­todi­al sen­tence not ex­ceed­ing three years or a mon­et­ary pen­alty shall be im­posed.
