Art. 219298

Neg­lect of du­ties of care, su­per­vi­sion or edu­ca­tion

 

1 Any per­son who vi­ol­ates or neg­lects his or her du­ties of su­per­vi­sion and edu­ca­tion to­wards a minor and thus en­dangers the minor's phys­ic­al or men­tal de­vel­op­ment, shall be li­able to a cus­todi­al sen­tence not ex­ceed­ing three years or to a mon­et­ary pen­alty.

2 If the of­fence is com­mit­ted through neg­li­gence, a mon­et­ary pen­alty shall be im­posed. 299
