Prevention of an official act Any person who prevents a public authority, one of its members or a public official from carrying out an act which is one of their official duties shall be liable to a monetary penalty not exceeding 30 daily penalty units. Public officials also include employees of undertakings in terms of the Railways Act of 20 December 1957401, the Passenger Transport Act of 20 March 2009402 and the Goods Transport Act of 19 December 2008403, as well as employees of organisations operating with a licence from the Federal Office of Transport under the Federal Act of 18 June 2010404 on the Security Units of Public Transport Companies.405 400Amended by No I of the FA of 5 Oct. 1950, in force since 5 Jan. 1951 (AS 1951 116; BBl 1949 11249). 403 [AS 2009 5597, 6019; 2012 5619No I 5; 2013 1603. Regeste: Art. 4 Abs. 2 Rahmenabkommen über die Grenzabfertigung mit Deutschland; Art. 3 StGB; Art. 95 Abs. 1 lit. b SVG; Art. 4 SKV; mangelnde Fahrberechtigung beim bevorstehenden Grenzübertritt; örtliche Zuständigkeit und anwendbares Recht. Schweizerische Grenzbeamte sind befugt, am auf dem Gebiet Deutschlands gelegenen, im Sinne des Rahmenabkommens vereinbarten Grenzposten die Fahrbefugnis von mit dem Fahrzeug einreisenden Personen zu kontrollieren; bei einem mutmasslichen Verstoss gegen die Vorschrift von Art. 95 Abs. 1 lit. b SVG sind die schweizerischen Behörden für die Strafverfolgung zuständig (E. 1). |
