Art. 308438

Mit­ig­a­tion of the sen­tence and ex­emp­ted acts

 

1 If the of­fend­er makes his false ac­cus­a­tion (Art. 303), false re­port of an of­fence (Art. 304) or a false state­ment (Art. 306 and 307) of his own ac­cord and be­fore it has caused any leg­al det­ri­ment to oth­ers, the court may re­duce the sen­tence (Art. 48a) or waive a pen­alty.

2 The of­fend­er shall not be li­able to a pen­alty if he has made a false state­ment (Art. 306 and 307) be­cause:

a.
by testi­fy­ing truth­fully, he would risk pro­sec­u­tion; or
b.
by testi­fy­ing truth­fully, a re­l­at­ive or an­oth­er per­son to whom he is so closely re­lated that his con­duct is ex­cus­able would risk pro­sec­u­tion.
