Breach of professional confidentiality in research involving human beings 1 Any person who discloses without authorisation a professional secret that has come to his knowledge in the course of his research activities involving human beings in accordance with the Human Research Act of 30 September 2011461 shall be liable to a penalty in accordance with Article 321. 2 Professional secrets may be disclosed for the purpose of research into human diseases and concerning the structure and function of the human body if the requirements of Article 34 of the Human Research Act of 30 September 2011 are met and authorisation for disclosure has been obtained from the responsible ethics committee. 460Inserted by Annex No 4 of the FA of 19 June 1992 on Data Protection (AS 1993 1945; BBl 1988 II 413).
