Art. 150 Assurance of anonymity
1The director of proceedings may give an assurance to the person requiring protection that his or her anonymity will be preserved. 2The public prosecutor shall submit its assurance to the compulsory measures court within 30 days for approval; in doing so, it must specify all the details required to assess the legality of the measure. The decision of the compulsory measures court is final. 3If the compulsory measures court declines to approve the measure, any evidence already obtained subject to the assurance of anonymity shall be inadmissible. 4An assurance of anonymity that has been approved or granted is binding on all criminal justice authorities involved in the case. 5The person requiring protection may waive the requirement of anonymity at any time. 6The public prosecutor and the director of proceedings in the court shall revoke the assurance if there is clearly no longer a need for protection. |
