¹ If it is not com­pet­ent to or­der a good be­ha­viour bond in terms of Art­icle 66 SCC¹⁸¹ in the course of the crim­in­al pro­ceed­ings against the ac­cused, sep­ar­ate pro­ceed­ings shall be held.

² If the ac­cused is in de­ten­tion due to a risk that he or she will com­mit a threatened felony or mis­de­mean­our or that he or she will com­mit that felony or mis­de­mean­our again, a good be­ha­viour bond or­der is not com­pet­ent.

³ The ap­plic­a­tion to be­gin sep­ar­ate pro­ceed­ings must be sub­mit­ted to the pub­lic pro­sec­utor in the place where the threat was made or the in­ten­tion was ex­pressed to com­mit the of­fence again.
