Art. 248 Sealing of evidence 122

1 If the hold­er claims that, in view of Art­icle 264, spe­cif­ic re­cords or oth­er items may not be seized, crim­in­al justice au­thor­ity shall place the same un­der seal. The hold­er must make the re­quest with­in three days of the items be­ing se­cured. Dur­ing this peri­od and fol­low­ing any seal­ing, the crim­in­al justice au­thor­ity shall neither in­spect nor use the re­cords or items.

2 If the crim­in­al justice au­thor­ity es­tab­lishes that the hold­er is not the same per­son as the pro­pri­et­or, it shall give the pro­pri­et­or the op­por­tun­ity to re­quest seal­ing with­in three days.

3 Un­less the crim­in­al justice au­thor­ity files a re­quest for the re­mov­al of the seals with­in 20 days, the sealed re­cords and prop­erty shall be re­turned to the hold­er.
