Art. 388 Jurisdiction of the director of proceedings over measures directing proceedings and interim measures and decisions not to consider the substance of the case 264

1 The dir­ect­or of ap­pel­late pro­ceed­ings shall take the re­quired meas­ures dir­ect­ing pro­ceed­ings and in­ter­im meas­ures that can­not be delayed. He or she may in par­tic­u­lar:

a.
in­struct the pub­lic pro­sec­utor to take evid­ence where this can­not be delayed;
b.
or­der de­ten­tion;
c.
ap­point a duty de­fence law­yer.

2 He or she shall de­cide not to con­sider the sub­stance of:

a.
clearly in­ad­miss­ible ap­pel­late rem­ed­ies;
b.
ap­pel­late rem­ed­ies that are clearly based on in­suf­fi­cient grounds;
c.
ap­pel­late rem­ed­ies that are quer­ulant or vex­a­tious.265
