Art. 256 Mass testing 131

1 In an in­vest­ig­a­tion in­to a felony, the com­puls­ory meas­ures court may at the re­quest of the pub­lic pro­sec­utor or­der that samples be taken to cre­ate DNA pro­files from per­sons who dis­play spe­cif­ic char­ac­ter­ist­ics es­tab­lished as be­ing rel­ev­ant to the com­mis­sion of the of­fence. The group of per­sons to be in­vest­ig­ated may be more strictly defined by means of phen­o­typ­ing in ac­cord­ance with Art­icle 258b.

2 If the pro­file com­par­is­on in ac­cord­ance with para­graph 1 does not pro­duce a match, the com­puls­ory meas­ures court may, at the re­quest of the pub­lic pro­sec­utor, or­der that a fa­mili­al re­la­tion­ship with the per­son to whom forensic evid­ence per­tains be used as a basis for fur­ther in­vest­ig­a­tions.
