Art. 168 Industrial sectors concerned

1 In­dus­tri­al sec­tors in­volving NORM are, in par­tic­u­lar:

a.
ground­wa­ter fil­tra­tion fa­cil­it­ies;
b.
gas pro­duc­tion;
c.
geo­therm­al en­ergy pro­duc­tion (deep geo­therm­al en­ergy);
d.
zir­con and zir­coni­um in­dustry;
e.
ce­ment pro­duc­tion and main­ten­ance of clinker ovens;
f.
main­ten­ance and re­mov­al of heat-res­ist­ant zir­coni­um al­loy clad­ding;
g.
tun­nel­ling in rock form­a­tions with el­ev­ated urani­um or thori­um con­cen­tra­tions.

2 In in­dus­tri­al sec­tors in­volving NORM, en­ter­prises shall de­term­ine by means of rep­res­ent­at­ive meas­ure­ments wheth­er:

a.
the NORM clear­ance lim­it is ex­ceeded in dis­charged ma­ter­i­als;
b.
staff are oc­cu­pa­tion­ally ex­posed per­sons as defined in Art­icle 51 para­graphs 1 and 2;
c.
the hand­ling of NORM may lead to a dose for mem­bers of the pub­lic which is not neg­li­gible from a ra­di­olo­gic­al pro­tec­tion point of view.

3 The en­ter­prises shall sub­mit evid­ence of the tests con­duc­ted in ac­cord­ance with para­graph 2 and the res­ults there­of to the FOPH.

4 The FOPH shall sup­port the en­ter­prises in the de­term­in­a­tion of the situ­ations spe­cified in para­graph 2 let­ters b and c.

5In in­dus­tri­al sec­tors in­volving NORM, the FOPH and Suva may con­duct spot-check meas­ure­ments.
